Copyright Infringement upon The Wandering Earth--Three Suspects Were Prosecuted

 

On April 29 this year, the Ministry of Public Security announced that one of the ten typical cases of copyright infringement, which involved Yan Moumou (anonym) and others in Nanjing, had made the latest progress. Three defendants involved in the case had been prosecuted by the prosecution.

On 31 August, the People’s Procuratorate of Jiangsu Province informed that on 27 August, the Nanjing Railway Transport Procuratorate prosecuted three defendants, including Yan Moumou, for copyright infringement. The case was uncovered by Nanjing police in March this year on the basis of the “215”  special cases handed over by the Ministry of Public Security. It was listed as one of the ten typical cases of copyright infringement by the Ministry of Public Security, and was notified at a press conference held on 29 April.

It has been found out that the defendant Yan Moumou and others had registered domain names and rented servers. Yang Mou, the technical director of a company, was in charge of providing technical support and had set up a special website. Yang Mou and the administrator Yin Moumou published a large number of unauthorized pirated film and television resources on the website for others to download. They made profits by collecting membership fees and divided up the money.

During the Spring Festival of 2019, Yin Moumou released seven film resources on the Internet, such as “The Wandering Earth”, “Pegasus”, “The New King of Comedy”, and “Crazy Alien”. After being reported, Yin Moumou immediately deleted the resource posts and the website was shut down by Yan Mou. In early March, Yan Moumou and Yin Moumou relocated the original website data through Yang Mou, re-established the download website of pirated film and television resources, released a large number of pirated movies, and continued to make profits by collecting membership fees.

On 8 March, the public security organs arrested the three defendants and applied for approval for arrest on 8 April. On April 12, the Nanjing Railway Transport Procuratorate approved the arrest of the three suspects on suspicion of copyright infringement. On July 12, the public security organs transferred the case for examination and prosecution. The investigation team of Nanjing Railway Transport Procuratorate carefully verified all the data in the case and supplemented the relevant evidence. On August 27, they filed a public prosecution in the court.
