Huawei Releases White Paper on Innovation and Intellectual Property: Never Politicize Intellectual Property

Huawei released a white paper on innovation and intellectual property on June 27, and warned against the politicization of this issue. Song Liuping, chief legal officer of Huawei, said on the press conference held in Shenzhen that intellectual property served as the foundation for innovation and its politicization would threaten technological achievements across the globe.

“If intellectual property finally became a political tool, people’s confidence in patent protection system would be dampened,” said Song.

The white paper, titled Respecting and Protecting Intellectual Property: The Foundation of Innovation, elaborates on Huawei’s practices in and contributions to innovation and intellectual property protection.

According to the white paper, innovation and intellectual property protection are reasons behind Huawei’s success in the past three decades. As of the end of 2018, Huawei has been granted 87,805 patents, of which 11,152 were American patents. Since 2015, the revenue created by intellectual property has exceeded $1.4 billion.

Excepting for developing its own patents, Huawei has altogether paid more than $6 billion worth of royalties to other companies, of which nearly 80% were American companies.

Intellectual property was private property protected by law, and IP-related disputes should be resolved through legal procedures, said Song, adding that in the past three decades, no court has ever concluded that Huawei engaged in malicious IP theft, and Huawei has never been required by any court to pay damages for this.

Song pointed out that even clients from certain countries who did not directly buy products from Huawei were using some core patents and sharing the benefits created by Huawei technologies.

Song also expressed Huawei’s position on the use of patents, saying that Huawei would never use patent families as “weapons”. Rather, it would follow the principle of FRAND (Fair, Reasonable and Non-discriminatory) with an attitude of openness and cooperation, and engage in discussions on patent licensing with relevant parties.

“Huawei is willing to share 5G and other technologies with the rest of the world, including American companies and consumers, to promote the development of our industry and human beings as a whole,” said Song.
