Xiaomi Sued A Xi’an-Based Electronics Store for Trademark Infringement

Xiaomi sued an electronics store located in Beilin District of Xi’an, claiming that the power adapter and charging cable infringed its trademark. Recently, the case was heard in the People’s Court of Beilin District and both sides agreed on a settlement.

Xiaomi alleged that it applied to the State Trademark Office for registration of the No.8228211 and No.8911270 trademark on April 28, 2011 and July 7, 2012 respectively. The approved range of commodities were all class 9, including power adapter, charging cable, mobile phone and headset. The plaintiff’s right to exclusive use of registered trademarks is still valid. The registered trademarks are widely used in Xiaomi’s smart phones, headphones, routers and televisions, and well recognized by customers for their uniqueness and distinctiveness.

Xiaomi said, the power adapters and charging cables sold by the defendant used the same characters and figures, and thus infringed its trademark, causing severe economic loss and undermining its goodwill.

The defendant should, according to the court, immediately stop selling infringed products and clear inventory. 25,000 Yuan should be paid for economic loss (including reasonable fees paid for investigation, evidence collection and lawyer). Furthermore, the defendant needs to publish an apologizing statement on the China Intellectual News to eliminate negative impacts.

Both sides agreed on a settlement.
