Infringe Copyright of Counterfeited Online Game

A Gang was Judged Infringing Copyright for Making Profits of 8 Million Yuan for 2 Years in Operating a Counterfeited Online Game

Li Han, Li Jiao and Li Ming were judged infringing copyright by Siming District Procuratorate Office for the first instance on May 21. They made profits of 8 million Yuan in operating a counterfeited popular online game by acquiring source game code illegally and building the private server. The suspects were sentenced imprisonment ranging from a year to three and a half years with a fine of 4.3 million Yuan.

From January 2016 to May 2018, Li Han and Li Jiao rented a private server to operate the counterfeited online game Jiuyouwanmei without the permission of Perfect World Co., Ltd., the original copyright owner of the online game Perfect World. By selling game coins and game gears to the players with the third-party payment supported by a certain Tianjin-based Internet technology company, Li Han had earned 8 million Yuan illegal merchandise income. Li Jiao was in charge of question consultation & solution and game order management. Li Ming was guilty of providing bank accounts and helping withdraw the income for Li Han, knowing his action was defined illegal.

Because of the long duration and great amount of the involved money in the counterfeited game operation, regular changes of leasers and the fourth party payment which was hard to track the source, the case was difficult to crack down. To judge the conviction accurately and fight against the illegal action, the Procuratorate took measures to guide the investigation organs to carry out the investigation, obtain evidence, clarify the bank accounts, find out the vital witnesses, collect and fix evidence in time,  and educate the defendants about the law. As a result, the defendants were willing to confess their crime and compensated the plaintiff for their economic cost of 1.7 million Yuan, which gained them the forgiveness from the victim.
