Danisa Accused Kjeldsens with Compensation of 30 Million Yuan in China

The delicious butter cookies originated from Europe are famous all over the world, among which the Danish cookies earn the most reputation. However, there was a “war” in court between the Danish cookies manufacturers Danisa and Kjeldsens. The case was accepted by the People’s Court of Haidian District, Beijing. The plaintiff Danisa asked for compensation of 30 million Yuan with the accusation of unfair competition.

In the statement given by the manufacturer Denmark Danisa Speciality Foods Aps and the distributor Youyijia(Shanghai) Food Trading Co., Ltd., the Danisa Cookies had been popular in the market of mainland China for continuous years and led the way in sales. Thus, the products could be defined as a well-known commodity. However, the manufacturers, importers and distributors of the Kjeldsens Cookies, including Denmark Kjeldsens Ltd., Ddenmark Kjeldsens Cookies Ltd., Kjeldsens Campbell’s(Shanghai) Management Ltd., Shanghai Lizhi Enterprise Ltd., Shanghai Zhaoyu International Trade Co., Ltd. and Beijing Cuiweijiayuan Supermarket Franchise Co., Ltd., have conducted behaviors such as disinformation, misleading, commercial defamation, which could be defined as unfair competition.

Danisa argued that Kjeldsens’ misleading acts made people believe that there was a relationship between Kjeldsens and Danisa. The use of crown patterns in the product packages and the giveaways of Kjeldsens Cookies were similar to those of Danisa, which was defined as unauthorized use of similar well-known indicators of names, packages and designs of others. Apart from this, Kjeldsens claimed in their press conferences that Danisa infringed the package exclusive right of Kjeldsens as a well-known brand and disseminated misinformation to the media, which could be seen as a defamation to Danisa and caused losses to its business credits. Based on the fact, the six aforementioned companies were prosecuted by the plaintiff with compensation of 30 million Yuan.

The case is still under investigation at present.
