Recently, Shanghai Pudong Court issued a white paper and typical cases on new progress in judicial protection of cultural and creative copyright. It is reported that from August 2021 to July 2022, the Pudong Court accepted a total of 12,943 cultural and creative copyright cases, with a year-on-year increase of 2.17%, including 12,940 civil cases and 3 criminal cases. A total of 13,685 cultural and creative copyright cases were concluded, up 10.6% year on year, including 13,682 civil cases and 3 criminal cases. Cultural and creative copyright cases accepted accounted for 84.4 percent of the total 15,335 intellectual property cases.


Among the civil cases of cultural and creative copyright accepted, there were 69 cases of copyright contracts, the rest being cases of copyright infringement. In addition, the plaintiffs advocated the application of both the Copyright Law and the Anti-Unfair Competition Law in 77 cases, indicating that the intellectual property protection in the cultural and creative industry in Pudong New Area is becoming increasingly complex, not just limited to the protection of the works themselves, but also showing a trend of comprehensive protection of business models and competitive advantages.
